TRF2 unanimously upheld the lower-court decision in favor of ABPI in Public Civil Action No. 5095710-55.2021.4.02.5101/RJ, filed against INPI and the Federal Government.
The ruling has a structural character and reinforces a forward-looking path for diagnosis and continuous improvement at INPI, aiming to ensure the material and financial conditions necessary to strengthen its institutional activities.
The judgment was delivered by the 1st Specialized Panel of TRF2, which highlighted the relevance of ABPI’s role and its important contribution to the defense of Brazilian Industrial Property.
ABIFINA (Brazilian Association of Fine Chemical, Biotechnology and Specialty Industries) and ABAPI (Brazilian Association of Industrial Property Agents) acted as amici curiae, contributing relevant technical inputs to the debate.
